Contest Overview:

The Ugly Furnace Contest (the "Contest") is organized by Mitchell Heating (the "Sponsor"). The Contest seeks to find the ugliest furnace unit in Colorado homes. The winner will receive a new residential furnace valued at up to $4,500, including standard installation.

Basic Promotional Rules

  • Who Can Enter: Legal U.S. residents in Denver County, Colorado, or El Paso County, Colorado, 18 years or older, who own their home and the furnace entered.
  • What You Win: A Trane furnace (up to $4,500 value) with professional standard installation by Mitchell Heating.
  • How to Enter: Submit a photo and description of your furnace on our website. Tag us on Facebook, TikTok, or Instagram for additional entries!
  • Entry Deadline: January 31, 2025.
  • Judging: Based on appearance and creativity. Winner will be selected by February 5, 2025.
  • Other Prizes: Humidifiers, air purifiers, and Bubbas 33 and Texas Roadhouse Gift Cards also available.

Full Official Rules

Eligibility:

  • Open to legal U.S. residents of Denver County, Colorado, or El Paso County, Colorado aged 18 or older.
  • Homeowners only. The furnace must be installed in the entrant's primary residence.
  • Employees of Mitchell Heating, Trane, their affiliates, and their immediate family members are not eligible.

Contest Period:

  • Entry submissions are accepted from December 5, 2024, to January 31, 2025.
  • Winners will be selected on February 5, 2025.

How to Enter:

  1. Submit a photo and description of your furnace on our website.
  2. Tag us on Facebook, TikTok, or Instagram for additional entries.

Entry Guidelines:

  • Photos must be original, unedited, and submitted by the homeowner.
  • Descriptions should highlight why the furnace deserves to win.
  • Entries must not contain offensive, illegal, or inappropriate content.

Judging Criteria:

  • Overall condition and appearance of the furnace.
  • Creativity and humor in the description.

A panel of judges selected by Mitchell Heating will evaluate the entries. Their decision is final.

Prizes:

  1. Grand Prize: A new Trane furnace (up to $4,500 value) with complimentary standard installation.
    • Winner must cover additional costs for upgrades, code compliance, or repairs not covered in standard installation.
  2. Additional Prizes:
    • 1 Humidifier: Whole-home system (value: $750).
    • 2 Air Purifiers: Removes pollutants (value: $500 each).
    • 4 Bubbas 33/TexasRoad House Gift Card: Two in Denver County and Two in El Paso County (value $100 each)

Winner Selection and Notification:

  • Winner selected by Mitchell Heating’s management team based on criteria outlined above.
  • Notification via email and certified letter. Winner must respond within 7 business days or risk forfeiture.

Conditions of Participation:

  • By entering, participants agree to these rules and authorize the use of their submitted materials for promotional purposes.
  • Limit one entry per household.
  • Winners must provide proof of eligibility and complete prize claim procedures, including signing a release.

Liability Release:

Participants release the Sponsor from any liability arising from participation in the Contest or use of the prize.

 

Privacy:

Personal information collected will be used solely for Contest administration and promotional purposes by the Sponsor.

Additional Terms:

  • The Sponsor reserves the right to disqualify entries that do not comply with the rules.
  • Void where prohibited. The Contest is subject to applicable federal, state, and local laws.

Contest Details:
Winners will receive a Trane furnace valued at up to $4,500, along with complimentary standard installation provided by Mitchell Heating. Any upgrades exceeding the contest value will be the responsibility of the homeowner. This contest has no cash value and is void where prohibited. Each household is limited to one entry; multiple entries will result in disqualification. This offer cannot be combined with any other promotions. By entering, participants agree to comply with all promotion rules. Contest rules are subject to change at the discretion of the Sponsor.

Eligibility:
This contest is open exclusively to legal U.S. residents aged 18 or older at the time of entry who reside in Denver County, Colorado, or El Paso County, Colorado. Prizes are non-transferable. Individuals who have won a contest hosted or sponsored by the Sponsor or its affiliates within the last 90 days are ineligible to participate. The Sponsor reserves the right to limit winners to individuals whose primary residence is within a 60-mile radius of the designated area.

By entering, participants agree to comply with all applicable laws and these Official Rules and accept all decisions made by the Sponsor as final. The Sponsor retains the right to disqualify any participant who does not adhere to these Official Rules. “Official Rules” include the rules provided on the contest entry page, this document, and any Additional Official Rules accessible through this page.

WINNER SELECTION. Winner will be selected  February 5, 2025 by the management team of Mithcell Heating. Winner will be notified by certified mail. Winners need to reply within 7 business days of the prize winning notification email. Otherwise, prize may be forfeit, and an alternate Winner will be randomly selected from among the remaining eligible entries, time permitting. Sponsor is not responsible for incomplete, incomprehensible, illegible, or out-of-service contact information.

 

PRIZE CLAIM. Prizes can be claimed by scheduling an estimate with Mitchell Heating, so the Sponsor can qualify the winner and begin the Furnace Replacement process. Government identification is required.

 

PRIZES:

Grand Prize: A new Trane furnace (up to $4,500 value) with complimentary standard installation.

    • Winner must cover additional costs for upgrades, code compliance, or repairs not covered in standard installation.

Additional Prizes:

    • 1 Humidifier: Whole-home system (value: $750).

Miscellaneous:
The Sponsor reserves the right to use any information related to the Contest, including details obtained from contestants during the contest, for marketing or other purposes, unless prohibited by law. The Sponsor is not responsible for internet crashes, slowdowns due to network congestion, viruses, sabotage, satellite failures, phone line disruptions, electrical outages, natural disasters, or other acts beyond their control. All posted results are unofficial until winners respond to email notifications and complete an estimate with the Sponsor. This contest is not intended for gambling purposes. Contestants found using the contest for gambling will be disqualified and reported to authorities.

No Association with Facebook:
This promotion is in no way sponsored, endorsed, administered by, or associated with Facebook. By participating, you provide your information to the Sponsor, not to Facebook. Your name may be used on Facebook to announce winners. Any questions, comments, or complaints about the promotion should be directed to the Sponsor, not Facebook. By entering, you release Facebook from all liability related to this promotion.

Additional Official Rules:
No purchase is necessary to enter or win. Making a purchase will not increase your chances of winning. This contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or restricted by law. These Additional Official Rules supplement the rules available on the contest entry page and, together, they comprise the "Official Rules." For further details, please see the contest entry page. The term "Sweepstakes" in these Official Rules refers to both sweepstakes and contests.

Additional Eligibility Restrictions:
This Sweepstakes is open only to legal U.S. residents submitting entries from within the United States. Employees, affiliates, subsidiaries, parents, advertising and promotional agencies, and other companies associated with the Sponsor (collectively, "Sweepstakes Parties") and their immediate family members or individuals residing in the same household are not eligible to participate. "Immediate family members" include spouses, parents, grandparents, siblings, children, and grandchildren. Entries from groups, clubs, or organizations, as well as the reproduction or distribution of these Official Rules for group participation, are not allowed.

Proof of age, identity, and eligibility must be provided upon request. Incomplete or inaccurate entry information may result in disqualification. The Sponsor will not award prizes to individuals who fail to meet eligibility requirements at the time of entry.

 

Entries:
The Sponsor will not confirm receipt of entries, and incomplete entries are void. The Sponsor is not responsible for entries that are lost, late, misdirected, incomplete, illegible, damaged, undeliverable, or delayed. Photocopied, artificially, or mechanically generated entries are void. Automated entries are also void.

Electronic entries will be considered submitted by the authorized account holder of the email address provided at the time of entry. The "authorized account holder" is defined as the individual assigned to an email address by an internet access provider, online service provider, or other organization responsible for assigning email addresses. Entries become the property of the Sponsor and will not be returned. Participants must provide a valid email address and are responsible for notifying the Sponsor of any changes to their email address. Winners may be required to prove they are the authorized account holder of the email address used for the winning entry.

Intellectual Property Guidelines:
Entries involving user-submitted content must adhere to the following guidelines:

  1. All submissions must be original work and must not infringe on any patent, trademark, copyright, trade secret, or other rights of any third party. The participant or legal guardian warrants that they hold all rights to the submitted material. The Sponsor reserves the right to disqualify any entry that infringes on intellectual property rights.
  2. Participants or their legal guardians agree to indemnify the Sponsor and Contest Entities from all claims and expenses, including attorney fees, arising from the entry's content or failure to comply with these rules.
  3. All entries will be considered "work for hire" under copyright law and become the exclusive property of the Sponsor.

By participating, the entrant or their legal guardian transfers all rights to the Sponsor, agreeing to execute additional documents if required. The Sponsor gains exclusive rights to use, reproduce, modify, publish, and distribute the entry in any medium, indefinitely, without additional compensation unless otherwise stated in these rules.
4. The Sponsor may disqualify any entry that fails to meet these guidelines, infringes on others' intellectual property, or contains offensive, obscene, or inappropriate material, or any content that may lead to civil or criminal liability under applicable laws.
5. Entries are subject to review after submission to ensure compliance with these rules. Non-compliant entries may be disqualified.

Additional Prize Claim Details:
Prizes must be claimed as specified on the contest page. Winners must provide valid government-issued identification to claim the prize. Prizes are non-transferable, not redeemable for cash, and cannot be substituted by winners. The Sponsor reserves the right to substitute a prize of equal or greater value if the original prize becomes unavailable.

All expenses, charges, fees, and costs not explicitly included in the prize description (e.g., transportation, taxes, gratuities, licenses) are the responsibility of the winner and, if applicable, their guests. Prizes with a retail value exceeding $600 will be reported to the IRS via Form 1099.

To be declared a winner, recipients may be required to sign and return an Affidavit of Eligibility, Prize Acceptance Form, Liability Release, and/or a Publicity Release, where permissible by law. Guests, if applicable, may also need to sign liability and publicity releases. Failure to submit required forms by the specified deadline may result in disqualification and selection of an alternate winner.

Use of Sweepstakes Information; Publicity Release
By entering the Sweepstakes, participants grant the Sweepstakes Parties the right to use any information provided in connection with the Sweepstakes for marketing or other purposes, except where prohibited by law. Entry constitutes consent to use, reproduce, or publish the participant’s name, likeness, voice, prize information, and biographical details for publicity, promotion, and advertising purposes in any media (e.g., Internet, television, radio, print) in perpetuity without compensation or further approval, unless prohibited by law. Winners may be required to sign a Publicity Release to allow the Sponsor such use.

Conduct; No Interference with Sweepstakes Operation
By entering, participants agree to abide by these Official Rules and the decisions of the Sponsor, which are final and binding. Participants must comply with all applicable laws and agree not to use language or actions that are obscene, defamatory, or infringe on others' rights. Entrants must not tamper with or disrupt the Sweepstakes, and any such attempt may result in disqualification and possible legal action.

Caution
Any attempt to damage the Sweepstakes website or undermine its operation is a violation of law. The Sponsor reserves the right to seek damages and remedies to the fullest extent permitted by law, disqualify violators, and take appropriate action, including cancellation or suspension of the Sweepstakes.

General Conditions; Disclaimer of Warranty
The Sponsor reserves the right to modify, suspend, or terminate the Sweepstakes in the event of unforeseen circumstances (e.g., natural disasters, fraud, technical failures). The Sponsor may disqualify entrants who tamper with the process or otherwise violate the rules. The Sweepstakes Parties are not responsible for technical issues, errors, or disruptions affecting entries or participation. No warranties or guarantees are provided for prizes.

Intellectual Property
All materials related to the Sweepstakes, including its name and associated trademarks, are the property of the Sponsor. Unauthorized use or reproduction is strictly prohibited.

Limitation of Liability
Participants agree to hold the Sweepstakes Parties harmless from any claims, damages, or losses resulting from participation, prize use, or technical issues. Winners are responsible for any taxes or fees associated with prizes valued over $600.

Choice of Law
All disputes will be resolved in the courts of Pueblo, Colorado, under Colorado state law. Participants waive the right to class actions and agree to individual resolution of disputes.

Privacy and Communication
Participant information is subject to the Sponsor's privacy policy and may be shared for marketing purposes. By entering, participants consent to email communications from the Sponsor, which they can opt out of at any time.

Official Rules and Winner List
A copy of these Official Rules and the winner list can be obtained by sending a self-addressed, stamped envelope to the Sponsor’s address (as indicated on the contest page). Requests must be made within 60 days of the winner announcement.

Rules; Changes
The Sponsor reserves the right to amend these rules to ensure fair administration or comply with applicable laws. Failure to enforce any rule does not constitute a waiver.
